Ten years after a person has successfully completed their sentence they can have their attorney petition the court for an expungement of their record. Expungement removes the record from the KBI criminal history database and orders the court files sealed. This means that employers and the public will not be able to find the DUI arrest or conviction on a person's record. Once expunged the person is also authorized to say that they were not convicted of the DUI, including when you fill out job applications. However, if you pick up another DUI offense in the future the court will be able to see the expunged DUI and use it against you.
