The Penalties of a Conviction
If you are facing a charge for possession of a firearm under the influence, you may suffer some severe penalties if you are convicted.
To secure a conviction, the state will have to prove one of the following beyond a reasonable doubt:
- You could not safely operate a firearm because you were under the influence of drugs or alcohol.
- You had a BAC of .08 or more.
It is not uncommon for this charge to accompany a DUI charge. For example, if you were pulled over because a law enforcement officer suspected you were driving under the influence and, during the DUI investigation, your firearm was discovered, you may be charged with a DUI and possession of a firearm under the influence.
Moreover, this charge is a class A misdemeanor and, if convicted, you could face up to one year in jail. You may also be responsible for steep civil fines and your concealed carry license will likely be revoked for at least one year. If this is your second conviction, it may be revoked for three years.

"I Would Highly Recommend Giving Robert a Call"Robert was very easy to work with. He took care of my speeding ticket for a very reasonable fee and had the ticket amended down to a non-moving violation so no points against my drivers license or insurance rate increases. If you have a speeding ticket in the KC area that needs to be dealt with, I would highly recommend giving Robert a call.Mat

"Very Respectful and Understanding Throughout the Process"I contacted Gigstad Law Office when I found myself being charged with a DUI in the state of Kansas. Although I've used other lawyers in the past for other types of legal situations, I've found, much to my disappointment, that they can often be flaky, or lacking in timely communication and responsiveness. I found that Mr. Gigstad was just the opposite. His rates are reasonable, he didn't drop the ball when I needed immediate legal advice, and was very respectful and understanding throughout the process. I would definitely recommend his services.DUI Client

"Robert Assisted Me in Doing Something I Didn't Know Was Possible"Robert assisted me in doing something I didn't know was possible - finally putting a bad decision I made 14 years ago behind me. Although I appreciated his professional and respectful approach to his work, I hope I never need his services again. If I do however, I would not hesitate to call him.DUI Client

"I Always Felt "in the Loop""Robert was extremely responsive from day one - returning my email contact request almost immediately. He walked me through the process and answered all my questions honestly and promptly. I always felt "in the loop". I originally contacted him because he was the only Johnson County attorney I found that had listed in his advertisement, expungement, as a service he provided. Robert assisted me in doing something I didn't know was possible - finally putting a bad decision I made 14 years ago behind me. Although I appreciated his professional and respectful approach to his work, I hope I never need his services again. If I do however, I would not hesitate to call him.DWI Client

"Extremely Responsive, Straight Talking Attorney That Carries Himself like None I Have Ever Used"Extremely responsive, straight talking attorney that carries himself like none I have ever used in the past. Treated me like he was providing a service, rather than doing me a favor by taking my case. Gave me his opinion of my case and his recommendation on how he would approach it but let me make the final decisions. In the end he negotiated a deal with the prosecuting attorney that was better than I thought possible. Zero jail time and minimum fines totaling $250(maximum was $2500). Now, 6 months later he was able to get all of my remaining probation time terminated for good behavior. During that time he also helped out with a lease agreement for a rental property, and a bid contract. Considering the level of service I received and the results I got, in the future I won’t use anyone else.Criminal Defense Client

"I Appreciate Robert's Efficiency and Patience"I really appreciate Robert's help with my case. I was ashamed, stressed and overwhelmed due to my intent to deprive charge. Robert made the process very easy and reminded me that everyone makes mistakes and no one is perfect. I never felt judged or as though he was telling me what I wanted to hear for money, he is sincere! I appreciate Robert's efficiency and patience, he always took time to explain everything in detail, e-mailed and/or called me back within the same business day. I never had to attend court until I signed my diversion paperwork. Needless to say I wouldn't hesitate to rehire Robert and you won't be disappointed for choosing Robert.E.E
