What is Considered Criminal Property Damage?
In Kansas, there are essentially two conditions under which you can face charges of criminal property damage. First, you cannot intentionally damage, vandalize, or otherwise impair the use of property that you have no right to damage. Second, you cannot damage any property for fraudulent purposes, such as defrauding the lienholder or collecting insurance.
If you've been accused of either of these two offenses, the charges against you will be influenced by the value of the property in question:
- Damages to property worth more than $25,000 is a severity level 7 nonperson felony, which means you could face between 11 and 13 years in prison.
- For property worth less than $25,000, but more than $1,000, the crime is a severity level 9 nonperson felony, punishable by 5 to 7 years behind bars.
- Damage to property valued at $1,000 or less will subject you to a Class B nonperson misdemeanor charge, which carries a potential jail sentence of up to 6 months.
When Arson Causes Property Damage
While the statutes discussed above cover the vast majority of criminal property damage cases, damaging property via arson will typically subject you to more severe penalties than would otherwise apply. If the arson was aggravated, meaning the property was occupied or the arson led to great harm for a firefighter or law enforcement officer, the charges will be even more severe.
