What is Considered Criminal Property Damage?
In Kansas, there are essentially two conditions under which you can face charges of criminal property damage. First, you cannot intentionally damage, vandalize, or otherwise impair the use of property that you no right to damage. Second, you cannot damage any property for fraudulent purposes, such as defrauding the lien holder or collecting insurance.
If you've been accused of either of these two offenses, the charges against you will be influenced by the value of the property in question:
- Damages to property worth more than $25,000 is a severity level 7 nonperson felony, which means you could face between 11 and 13 years in prison.
- For property worth less than $25,000, but more than $1,000, the crime is a severity level 9 nonperson felony, punishable by 5 to 7 years behind bars.
- Damage to property valued at $1,000 or less will subject you to a Class B nonperson misdemeanor charge, which carries a potential jail sentence of up to 6 months.
When Arson Causes Property Damage
While the statutes discussed above cover the vast majority of criminal property damage cases, damaging property via arson will typically subject you to more severe penalties than would otherwise apply. If the arson was aggravated, meaning the property was occupied or the arson led to great harm for a firefighter or law enforcement officer, the charges will be even more severe.

Robert quickly found out what actions I could pursue with the moving violation I received. He took care of everything for me, and all I had to was give him the paperwork. I highly recommend Robert for consultation as my moving violation was skillfully changed to a non-moving violation and kept off my record/insurance.Mike

I got an MIP and Fake ID charge in Lawrence and Robert Gigstad was extremely helpful and thorough in handling my case. He always got back to me in a timely manner and kept me informed throughout the whole process, I got diversion for both charges so they will not be on my permanent record.Kelly

My dad has used Robert for several moving violations in the past and recommended that I give him a call for a speeding ticket of my own. Robert was extremely helpful and great to work with. He successfully got my speeding ticket reduced to a non moving violation.Happy Client

Mr. Gigstad provided excellent service in helping me to remedy several traffic tickets, one of which had potentially serious consequences. He was very responsive, attentive and followed through on helping me resolve this situation. He's a great guy as well and I can't recommend him enough!Rod

I really appreciate Robert's help with my case. I was ashamed, stressed and overwhelmed due to my intent to deprive charge. Robert made the process very easy and reminded me that everyone makes mistakes and no one is perfect. I never felt judged or as though he was telling me what I wanted to hear for money, he is sincere! I appreciate Robert's efficiency and patience, he always took time to explain everything in detail, e-mailed and/or called me back within the same business day. I never had to attend court until I signed my diversion paperwork. Needless to say I wouldn't hesitate to rehire Robert and you won't be disappointed for choosing Robert.E.E

Robert was extremely responsive from day one - returning my email contact request almost immediately. He walked me through the process and answered all my questions honestly and promptly. I always felt "in the loop". I originally contacted him because he was the only Johnson County attorney I found that had listed in his advertisement, expungement, as a service he provided. Robert assisted me in doing something I didn't know was possible - finally putting a bad decision I made 14 years ago behind me. Although I appreciated his professional and respectful approach to his work, I hope I never need his services again. If I do however, I would not hesitate to call him.DWI Client
